"Legal Research: How to find and understand the law by the attorney Stephen Elias, and the editors of Nolo's another great book in the library, published by Nolo Legal, a publisher that prides itself on making the law accessible to all. I am a lawyer and I still like the books, which published by Nolo, especially those to which I am not so familiar, but want a bit 'of knowledge. Nolo offers ever.
Not everyone can Westlaw or Lexis to provide the two major operatorson the basis of legal resources online. In law school we had access to both, because both companies want to earn your loyalty, when it gets out of control and began to practice. Many companies have one or the other, and I assume the big companies can subscribe to both. Even with access to one of them, I find that often they can find things faster and easier with free resources. Many states have laws and such on-line in recent days. More and more are becoming available all the time.
That's wherebook "legal research" comes in. It offers easy to follow methods of research to give you the answer to your legal questions. The book has sections for online research and information on library law for those who have access to one.
The book comprises 386 pages divided into ten chapters very informative. The chapters are:
One: Understand the fundamentals of the law. Brief description of what is right, against the sources of law, the stateFederal law and the courts. Even basic written for a lawyer, but also to lay the book, this is a good start.
Two: Finding Legal Notices. This chapter explains how and where the information is legal, primary and secondary sources, Internet resources, for legal issues and sites for legal research. It contains Lexis and Westlaw, but also other sites that are free. I like the tips and warnings for the book as well. Good guard that not every opinionIt 'a good law. At least for someone who had it drilled in during law school, but probably not known to many laymen.
Three: Identify the legal issue. Things to know before you go looking, it's like a civil or criminal, to experience the area of law you want to research what resources lies with what you need to find help, and your legal matter. This is important, you want to know what you are really lookinglooking for before you go.
Four: finding and using secondary sources. This chapter examines the sources, such as on-line resources (including a bit 'on the decision whether to trust), self-help legal books, legal encyclopedias, form books, manuals of practice, continuing legal education publications, reviews of law, and so on. Many law firms have a lot of these types of resources, and will not find in a library of law firm. This chapter provides a brief overview of whatThese sources.
Five: find and use the ordinances, statutes, regulations and ordinances. These are most of the legislative or administrative law, created and explained. In this chapter, as these resources and how to use them. It includes the constitutions to find and use to find federal, state adoption of the Statute, to understand to find the regulations and other laws and regulations. These are important, depending on the problem. This chapter is agood introduction into this world of "laws" for those charts unknown territory.
Six: Case Finding. Some of our law is not in the statute, but the decisions of cases that has already been decided. These cases interpreted the law and are now the rule, changes to legislation, or any other case of others, is overwritten. Roe v. Wade is an example of a famous case that is considered in relation to abortion law. This chapter helps the reader learn how to use quotes toCases to find cases on the Internet to find cases in the library.
Seven: The use of the law. This chapter explains what is really a case, as they were published, and influence how many cases before litigation. If you question is based on the law, contribute to this chapter.
Eight: Check your research. I indicated above, and this chapter goes beyond to help ensure that "good law." Teaches how to Shepardize a thing, a process that weLawyers use to those cases, we rely to ensure that there is still good. If you try to make a case yourself, you must make sure that you read about a "good". "These are the kinds of things that lawyers know that many lay people do not.
Nine: Organize and use the put in Legal Research. One thing that employees, the interiors of the law and employees spend much time in this is research. Once you find the information you need to put what you want in writing for those who are asked to find to find it.This chapter explains the basics of writing a legal agreement. Not complete as the semester class that hold the majority of first-year law students, but good for the non-lawyer. There is a short distance to go to court and the Court and on some pages to find and work with a lawyer.
Ten: hypothetical and memoranda of research. Perhaps it is because counsel for the case studies and examples to learn that this chapter is a research problem, as the facts are discovered, and thenApproach to address the issue of research. It 'very short, will be non-lawyers, a small example of how to search for in the law and beyond the search for your response.
The chapter book stop here on page 255 the next 100 pages, plus a glossary, a person would not be necessary if they have a legal dictionary. Nolo is really a simple legal dictionary, which replaces the "to Black, but it is a good resource. Then there is a short appendix on the issues and an index.
Overall, I think,This book could be very useful for the person, or will be, legal research must be done, but do not know where to begin. If you are forced to do-it-yourself, you can direct the path. This is a very good description of the legal process of research for those who do not have a law degree.
